This Acceptable Use Policy (“AUP”) governs your use of the hosting and related services provided by FairApex, owned and operated by Smart Information Technologies (Pvt) Limited, Islamabad, Pakistan (“FairApex”, “we”, “us” or “our”).
This AUP supplements and forms part of our Terms & Conditions. By purchasing, accessing or using our services, you agree to comply with this AUP.
You are responsible for ensuring that your use of our services, and where applicable the use of our services by persons or customers under your account, complies with this AUP and all applicable laws.
We may update this AUP from time to time in accordance with our Terms & Conditions.
To report spam, malware, phishing, security problems, copyright-related abuse, or other suspected misuse of services hosted through FairApex, please use the abuse or support contact information published on FairApex.com.
When reporting abuse, please provide enough information for us to identify and investigate the relevant service, domain, account, IP address, URL, email, message or other activity.
We may investigate reports received from customers, network providers, registries, security organisations, law-enforcement authorities and other third parties.
You may use our services only for legitimate purposes and in accordance with your purchased service, this AUP, our Terms & Conditions and applicable law.
You must not permit another person or organisation to access or use your FairApex account in a manner that is not permitted by your service.
Where you have purchased a service that expressly permits reselling, sublicensing or providing hosting to your own customers or other third parties, you may do so subject to the terms of that service.
If you provide our services to a third party through a reseller or other authorised arrangement, you are responsible for:
informing them of the applicable terms and policies;
taking reasonable steps to ensure their compliance;
monitoring their use of the services where appropriate; and
responding promptly to abuse or security issues involving their services.
A violation of this AUP by a person using services under your account may be treated as a violation by you, particularly where you authorised, enabled, failed to reasonably control, or benefited from the activity.
Shared hosting services are intended primarily for normal website, application and email-related use appropriate to the hosting package purchased.
Each hosting package is subject to the storage, bandwidth, processing, database, email, inode, process, connection and other technical limits or fair-use requirements applicable to that package.
Where a package is advertised as having unlimited or unmetered resources, such description does not mean that resources may be used without reasonable technical limitations or in a manner that negatively affects our infrastructure or other customers.
On shared hosting, you must not use resources in a manner that materially degrades, overloads or interferes with the performance, stability or security of the platform.
Examples of activities that may be restricted or prohibited on shared hosting include, without limitation:
long-running or unattended server-side processes or daemons;
IRC servers or services;
cryptocurrency mining;
resource-intensive automated processing;
web spiders, crawlers or indexers that create excessive resource usage;
gaming servers;
proxy or anonymisation services;
remote file-storage or file-hosting services;
peer-to-peer or file-sharing services;
torrent clients, trackers or similar applications;
self-hosted cloud-storage or file-synchronisation platforms;
using hosting primarily as an off-site backup repository; and
other activities that are inappropriate for a shared hosting environment.
Certain activities may be permitted on a suitable VPS, dedicated or other service where expressly supported by the applicable product. Permission on one service does not create a right to perform the same activity on another service.
We may contact you where your usage materially affects the operation of our systems or other customers’ services.
Where appropriate, we may require you to reduce resource usage, optimise applications, upgrade your service, migrate the relevant workload, or discontinue the activity.
If excessive or inappropriate resource usage creates an immediate risk to our systems, network or other customers, we may temporarily restrict or suspend the affected service without prior notice where reasonably necessary.
You may use our services only for lawful purposes.
You must not use, or permit others to use, our services:
In any way that violates any applicable law, regulation, court order, governmental requirement or other legal obligation.
For fraudulent, deceptive or unlawful activity.
To gain unauthorised access to any computer, network, server, account, database, application or information system.
To scan, probe, exploit, attack, compromise or interfere with systems or networks without proper authorisation.
To distribute malware, viruses, worms, ransomware, trojans, spyware, keyloggers, botnets, malicious scripts or other harmful code.
To facilitate phishing, credential theft, impersonation, scams, fake login pages or other attempts to deceive users into providing confidential information.
To launch, facilitate, coordinate or participate in denial-of-service, distributed denial-of-service or other disruptive attacks.
To send or facilitate the sending of unsolicited bulk email, spam or other unauthorised communications.
To host or distribute material that is unlawful or that infringes the legal rights of another person.
To operate services primarily intended to facilitate cyber abuse, credential theft, malware distribution, unauthorised access or similar malicious activity.
To interfere with, damage, disable or disrupt:
FairApex services;
our servers;
our networks;
our software;
our security systems;
another customer’s service; or
any third-party system or network.
To circumvent, disable or interfere with security, authentication, access-control or resource-limiting mechanisms.
To falsify headers, source addresses, routing information, domain information or other technical identifiers in order to disguise the origin of communications or activity.
To impersonate FairApex, Smart Information Technologies (Pvt) Limited, another customer, another individual, a business, a government body or another organisation.
To use FairApex infrastructure as a means of concealing or facilitating criminal, fraudulent or abusive activity.
These content standards apply to material you upload, publish, store, transmit or make available through our services (“Material”).
You are responsible for ensuring that your Material is lawful and that you have all rights, permissions and licences necessary to use it.
Material must not:
unlawfully infringe copyright, trademarks, patents, database rights, privacy rights or other intellectual-property rights;
be unlawfully defamatory;
unlawfully disclose confidential or private information;
facilitate fraud, deception or criminal activity;
contain or distribute malicious code;
unlawfully threaten, harass or intimidate another person;
impersonate another person or organisation;
falsely suggest that Material originates from FairApex when it does not;
facilitate unauthorised access to systems or accounts;
promote or facilitate unlawful activity; or
otherwise violate applicable law.
Certain types of content or activity may also be restricted where required by law, a competent authority, a domain registry, an upstream provider, our security requirements, or the service purchased.
Nothing in this section requires FairApex to monitor every website, file, communication or piece of Material hosted through our services.
FairApex maintains a zero-tolerance approach to spam, phishing and malicious email activity.
You must not use our services to send unsolicited bulk email or other unauthorised commercial or promotional communications.
You must not operate, maintain or use mailing lists containing recipients who have not appropriately consented to receive the relevant communications where consent is required.
You must not use forged sender addresses, deceptive headers, compromised accounts, malware-infected machines or other techniques intended to conceal the source of unsolicited or malicious email.
You must not advertise a website, service or resource through spam where the advertised website, service or resource is hosted through FairApex.
You must maintain reasonable safeguards over websites, scripts, forms, email accounts and applications under your control to reduce the risk that they are compromised and used for spam or malicious activity.
If activity associated with your account causes IP addresses, domains or mail infrastructure to be blacklisted, blocked or reputation-damaged, we may take action to protect our infrastructure and other customers.
Depending on the circumstances, we may:
suspend sending privileges;
suspend the affected website or account;
disable compromised scripts or email accounts;
require security remediation;
require password or credential changes;
require malware removal;
restrict outgoing email;
terminate the affected service; or
take other reasonable protective measures.
Where permitted by applicable law and our agreement with you, you may be responsible for reasonable third-party costs directly resulting from abusive activity attributable to your account, including technical remediation or blacklist-related costs.
You must take reasonable steps to protect your account, websites, applications, databases, email accounts and credentials.
You must keep software, plugins, themes, scripts, CMS installations and other applications reasonably updated where updates are necessary to address known security vulnerabilities.
You must not knowingly operate vulnerable or compromised applications that create an unreasonable risk to our infrastructure or other customers.
If we reasonably believe that a service has been compromised or is being used to compromise other systems, we may take immediate protective action, including isolation, suspension, traffic restriction or temporary disabling of affected functionality.
Where possible, we may provide information concerning the issue and reasonable steps that may be taken to restore the service.
You may not resell, sublicense, distribute or provide third parties with access to FairApex hosting services unless the product or plan you purchased expressly permits such activity.
If you purchase a reseller service, you are responsible for the use of the hosting accounts, websites, domains and other services you provision for your customers.
You must ensure that your customers are subject to terms and acceptable-use requirements that provide protections reasonably consistent with this AUP.
You are responsible for taking reasonable action when a customer under your reseller account violates this AUP or causes abuse, security problems, spam, blacklisting or other harm.
FairApex may require you to suspend, investigate, secure or terminate a downstream account where reasonably necessary to address abuse, security or legal concerns.
Where you operate reseller accounts or other downstream services, you are responsible for maintaining good housekeeping and removing services, websites, files or accounts that are no longer required.
Inactive reseller accounts or services may be deleted in accordance with the applicable service terms, FairApex’s operational policies and any applicable retention requirements.
We may investigate suspected violations of this AUP using reasonable technical and administrative measures.
You agree to cooperate reasonably with investigations involving your account where necessary to resolve security, abuse, spam, fraud or other material policy issues.
We may request information relevant to an investigation, including information necessary to determine the source, ownership or operation of a website, domain, account, script or other service.
We may preserve or disclose information where reasonably necessary to:
comply with applicable law;
respond to lawful requests from competent authorities;
protect our customers or infrastructure;
investigate fraud or abuse;
enforce our agreements; or
protect the rights, property or security of FairApex or others.
We may determine, acting reasonably and in accordance with the circumstances, whether your use of the services breaches this AUP.
A breach of this AUP may constitute a material breach of our Terms & Conditions.
Depending on the nature and seriousness of the breach, we may take one or more of the following actions:
issue a warning;
request corrective action;
require removal or modification of Material;
restrict specific functionality;
restrict outgoing email;
isolate or disable affected services;
temporarily suspend an account or service;
permanently suspend or terminate an account or service;
terminate downstream or reseller accounts;
report suspected unlawful activity to appropriate authorities;
preserve relevant information where appropriate; and
take legal action where necessary.
We may suspend or restrict a service without prior notice where we reasonably believe that immediate action is necessary to:
protect our infrastructure;
protect other customers;
stop active abuse;
prevent security compromise;
prevent ongoing fraud;
stop malicious traffic;
comply with law or an order from a competent authority; or
prevent significant harm.
Where the circumstances permit, we may provide notice and an opportunity to remedy the violation before taking further action.
Restoration of a suspended service may require evidence that the underlying issue has been fully addressed.
Suspension does not automatically eliminate any payment obligations, contractual liabilities or other rights arising under the Terms & Conditions.
Some FairApex services are dependent upon third-party providers, including hosting infrastructure providers, domain registries, registrars, network providers, software vendors, security providers and other suppliers.
You must comply with applicable requirements imposed by such providers where those requirements apply to your service.
Where an upstream provider or registry requires suspension, restriction, cancellation, migration or other action concerning a service, FairApex may take corresponding action where reasonably necessary.
We may also impose additional requirements where necessary to comply with upstream provider policies, security requirements or legal obligations.
Hosting services are provided for the purpose of hosting websites, applications, email and other permitted services associated with your purchased package.
You must not use ordinary shared hosting primarily as a remote file repository, personal cloud drive, file-distribution platform or off-site backup service.
Important data should always be maintained in an independent backup location.
We may revise this AUP from time to time by updating this page.
Changes may be made to reflect:
changes to our services;
changes to security practices;
changes to upstream-provider requirements;
changes in technology;
changes in applicable law; or
operational or business requirements.
The updated version will be published on FairApex.com together with the relevant “Last Updated” date.
Where a change materially affects your existing rights or obligations and notice is required by applicable law or our Terms & Conditions, we will provide such notice in an appropriate manner.
This AUP forms part of the FairApex Terms & Conditions.
If there is a conflict between this AUP and the Terms & Conditions, the Terms & Conditions will govern unless they expressly provide otherwise.
Additional service-specific rules may apply to particular products or services.
