1. About FairApex

FairApex is a domain and web hosting company operated by Smart Information Technologies (Pvt) Limited, Islamabad, Pakistan.

We provide digital and internet-related services to individuals, businesses, organisations and other customers.

Our services may include:

  • Web hosting;

  • Domain name renewals;

  • Business email and email hosting;

  • SSL certificates;

  • Virtual Private Servers (VPS);

  • Website and hosting migration;

  • Website-related technical services;

  • Hosting-related add-ons; and

  • Other digital services offered through FairApex.com.

Our hosting services may be delivered using infrastructure and services provided by established third-party technology and infrastructure providers.

2. Nature of Our Services

All FairApex services are digital or electronically delivered services.

We do not generally ship physical products.

Depending on the service purchased, delivery may occur through:

  • activation of a hosting account;

  • provision of access credentials;

  • activation of a domain service;

  • registration or transfer of a domain;

  • activation of email services;

  • issuance or activation of an SSL certificate;

  • provisioning of a VPS or other infrastructure;

  • completion of a website or email migration; or

  • activation of another digital service purchased through FairApex.

3. Ordering Services

3.1

Customers may purchase services through the FairApex website or customer portal.

3.2

Before placing an order, the customer will generally be shown the applicable service, pricing and relevant information.

3.3

An order is subject to acceptance by FairApex.

3.4

We may decline or cancel an order where the requested service is unavailable, payment cannot be verified, fraud or abuse is suspected, a domain cannot be registered, or another legitimate reason prevents us from providing the service.

4. Service Activation and Delivery

4.1

Most hosting services are activated electronically after successful order processing and payment verification.

4.2

Depending on the product, activation may be automated or may require manual review or configuration.

4.3

Domain registration and transfer services depend on the applicable domain registry and registrar and may take additional time to complete.

4.4

SSL certificates and other third-party services may require verification, issuance or activation by the relevant provider.

4.5

VPS and other infrastructure services may require provisioning and configuration before becoming fully operational.

4.6

Where a service cannot be activated immediately due to technical, verification, registry, payment or third-party requirements, we will use reasonable efforts to complete activation as soon as reasonably practicable.

5. Website and Email Migration

5.1

Where included in an applicable FairApex offer, we may provide website and/or email migration assistance at no additional charge.

5.2

Migration may include transferring website files, databases, email accounts and relevant configurations from an existing provider, subject to technical compatibility and access being available.

5.3

The customer must provide the information and access reasonably required to perform the migration.

5.4

Migration may depend upon the customer’s existing hosting provider, DNS configuration, software, control panel, website structure and other technical circumstances outside FairApex’s control.

5.5

We use reasonable efforts to perform migrations carefully and with minimal disruption, but cannot guarantee that every website, email account, application or configuration can be transferred without modification.

5.6

Where FairApex provides a free trial or staging migration, the applicable trial terms will apply.

6. Free Trial and “Pay Only If Satisfied” Offer

6.1

FairApex may provide selected customers with a free migration, staging environment or hosting trial under promotional offers such as “Migrate • Trial • Pay” or “Pay Only If Satisfied.”

6.2

A free trial allows the customer to evaluate the relevant service before committing to payment.

6.3

Where a trial is provided without payment, there is no refund associated with the trial because the customer has not paid for the trial service.

6.4

Where a customer subsequently chooses to purchase or continue with the service after using the trial, the subsequent purchase is governed by the applicable product and billing terms.

6.5

A trial conversion does not automatically create a new 30-day money-back period where the customer has already received and used the service as part of the FairApex trial, unless the applicable promotional terms expressly state otherwise.

6.6

FairApex may restrict or discontinue a free trial where it is being abused, duplicated, used fraudulently or used contrary to the applicable offer conditions.

7. Direct Hosting Purchases

7.1

Eligible hosting plans purchased directly from FairApex without first using a FairApex free trial are covered by our 30-day money-back guarantee, subject to the conditions and exclusions in our Refund & Cancellation Policy.

7.2

The money-back guarantee does not automatically apply to domains, private SSL certificates, VPS services, virtual nameservers, add-ons or other excluded products.

7.3

The complete refund requirements and exclusions are described in our Refund & Cancellation Policy.

8. Domain Services

8.1

FairApex may provide domain registration, transfer and renewal services through applicable registrars and registries.

8.2

Domain registrations and transfers are subject to availability and the rules, policies and requirements of the relevant domain registry and registrar.

8.3

FairApex does not guarantee that a requested domain name will be available or that a domain transfer will be accepted.

8.4

Domain registration and renewal charges are generally non-refundable once processed, subject to the applicable Refund & Cancellation Policy and the requirements of the relevant registry or registrar.

9. Hosting Infrastructure

9.1

FairApex hosting services may use infrastructure supplied by third-party hosting and technology providers.

9.2

The resources, specifications, storage, bandwidth, processing capacity, email limits and other features available to customers depend on the hosting package purchased.

9.3

Services are subject to reasonable technical and fair-use limitations.

9.4

Customers must use hosting services in accordance with the FairApex Acceptable Use Policy.

9.5

We may restrict or suspend services where necessary to protect our systems, infrastructure, customers or third-party providers.

12. Service Availability

12.1

FairApex uses reasonable efforts to maintain reliable services.

12.2

Service availability may be affected by planned maintenance, emergency maintenance, network problems, hardware or software failures, third-party provider issues, security incidents and circumstances outside our reasonable control.

12.3

We do not guarantee uninterrupted or completely error-free service unless a particular service expressly includes a specific service-level commitment.

13. Billing and Renewal

13.1

Customers are responsible for paying invoices and renewing services when due.

13.2

Recurring services may renew according to the billing arrangement selected during purchase.

13.3

Where automatic renewal is supported and enabled, the applicable payment method may be charged according to the relevant billing terms.

13.4

Domain renewal may be subject to separate registry and registrar requirements.

13.5

Failure to pay or renew may result in suspension, expiration or termination of the relevant service.

14. Cancellation and Refunds

14.1

Cancellation and refund requests are handled according to the FairApex Refund & Cancellation Policy.

14.2

Eligible direct hosting purchases may qualify for our 30-day money-back guarantee.

14.3

Free trial services for which the customer has made no payment are not subject to a refund.

14.4

Certain products and charges are excluded from the money-back guarantee, including applicable domain registration and renewal fees, private SSL certificates, VPS and associated products, virtual nameservers and other add-ons, as specified in our Refund & Cancellation Policy.

14.5

Customers should review the Refund & Cancellation Policy before purchasing a service.

15. Service Restrictions

  • malware;

  • security threats;

  • unlawful activity;

  • violation of the Acceptable Use Policy;

  • violation of the Terms & Conditions;

16.1

Certain FairApex services depend on third-party providers.

16.2

Third-party services may have their own terms, policies, technical requirements and availability limitations.

16.3

Where a third-party provider changes, suspends, discontinues or restricts a service, FairApex may need to modify, migrate, suspend or discontinue the corresponding service.

16.4

We will use reasonable efforts to manage such situations and, where practicable, communicate material changes affecting customers.

17. Service Changes

FairApex may modify, upgrade, replace or discontinue products, features or technical components from time to time.
